These Terms of Service (the “Terms”) are an agreement between you and Sol, an individual based in the United States (the “Operator”, “we”, “us” or “our”). They govern your access to and use of Underspire. They were last updated on 14 October 2026. Please read them carefully: they limit our liability and include a licence to the Content you submit.
1. Agreement and the Service
1.1 “Service” means the Underspire online game, including the game server and every connection to it (by a MUD client or by the web client), the website at https://underspire.net (the “Site”), the wiki, the Underspire Forums at https://agora.underspire.net (the “Forums”), the game’s mail, messaging, ticket and request systems, and all related software, text, images, tools and communications that the Operator operates or provides.
1.2 By creating an account, connecting to the game, or otherwise using any part of the Service, you agree to these Terms, to the Privacy Notice published at https://underspire.net/legal/privacy/ (the “Privacy Notice”) and to the Underspire Code of Conduct published at https://agora.underspire.net/t/code-of-conduct.10/ (the “Code of Conduct”). Together they are the “Agreement”. If you do not agree to the Agreement, you must not use the Service.
1.3 The Code of Conduct and the Privacy Notice form part of these Terms. If a provision of these Terms conflicts with the Code of Conduct about how a person must behave, the Code of Conduct prevails. In every other respect these Terms prevail.
1.4 The Service is provided free of charge by an individual with the help of volunteers. Nothing in the Agreement requires the Operator to provide the Service continuously, in any particular form or at all.
2. Who may use the Service
2.1 You must be at least eighteen (18) years of age. The Service contains mature themes, including violence and adult content, and no person under 18 may use it, even with the permission of a parent or guardian.
2.2 You represent and warrant that (a) you are at least 18 years old; (b) you have the legal capacity to enter into the Agreement; (c) you are not barred from using the Service under the law of any country that applies to you or by a previous termination of your access; and (d) the information you give us is accurate, and you will keep it accurate.
2.3 Each person may hold one account. You must not create an additional account to evade a restriction, to gain information or to obtain any other advantage, and you must not allow any other person to use your account.
2.4 If we learn that a person using the Service is under 18, we will end that person’s access and remove their personal information as described in the Privacy Notice.
3. Accounts and security
3.1 An account is created by registering a handle, a password and an email address. The email address must be valid and belong to you, and you must be able to receive mail at it. We may require you to confirm it before you apply for a character, post, or use other parts of the Service.
3.2 You are responsible for everything done through your account and your credentials. You must keep your password confidential, must use a password that you use nowhere else, must not share your account, and must tell staff without delay if you believe your account has been used without your permission. We will not ask you for your password.
3.3 We may refuse, change or reclaim a handle that impersonates another person, infringes a right, or is abusive, misleading or inappropriate.
3.4 You may ask for your account to be deleted at any time by contacting us at archeonsolUS@gmail.com or through the Service’s request system. The effect of deletion on your information and your content is set out in the Privacy Notice and in section 5. We may keep the records that we need to enforce a restriction, to protect the safety and security of others, to resolve a dispute and to comply with the law.
3.5 We may close an account that has been inactive for a long time. Where we have an email address on file, we will try to give notice first.
4. Conduct and the Code of Conduct
4.1 You must comply with the Code of Conduct and with every law that applies to your use of the Service. The Code of Conduct sets rules on consent, the separation of in-character and out-of-character conduct, the privacy of other players, adult content, exploits and automation, the use of generative artificial intelligence, reports, enforcement and appeals.
4.2 Without limiting section 4.1, you must not:
- use the Service for any unlawful purpose or in a way that infringes the rights of another person;
- harass, threaten, stalk, intimidate or discriminate against any person, or publish another person’s private or identifying information;
- post, send or store any sexual material that involves a person under 18 or a character who is portrayed as under 18. Such material is strictly prohibited and will be reported to the authorities as the law requires;
- post or distribute material that is defamatory, obscene beyond what the Code of Conduct permits, or that you have no right to distribute;
- probe, scan, attack or interfere with the Service or its security, scrape it in bulk, overload it, or use an automated tool, macro or script to gain an advantage or to bypass a game system;
- exploit a bug or unintended behaviour for an advantage, or fail to report one you have found;
- impersonate another person, misrepresent your affiliation, or deceive staff in a review;
- evade a restriction, suspension or ban, including by using another account or another person to do so; or
- buy, sell, trade, auction or otherwise exchange any account, character, item, currency or other element of the Service for money or for anything of value outside the Service.
4.3 Adult content and erotic roleplay between adults are permitted only as the Code of Conduct allows and with the consent it requires, and never in a space that a guest can read.
4.4 You may report a concern through the Service’s request system, through the report function of the Forums, or by email to archeonsolUS@gmail.com.
5. Your content and the licence you give
5.1 “Content” means anything you submit to or create in the Service, including character names, descriptions and backgrounds, roleplay (poses, speech, emotes and actions), messages, mail, tickets and requests, notes, profile text, wiki pages and edits, Forum posts, and links to pictures hosted elsewhere.
5.2 As between you and the Operator, you keep whatever rights you have in your original Content. The setting, the rules, the game systems and the other elements of the Service remain the property of the Operator or its licensors, as described in section 8.
5.3 You grant the Operator a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, copy, reproduce, display, transmit, format, excerpt and adapt your Content, and to distribute it to other users, in order to operate, secure, moderate, support, document and improve the Service, and to keep it as part of the shared history of the game. The Operator may sublicense this licence to the service providers that help it run the Service, only for that purpose.
5.4 The licence in section 5.3 continues for Content that has become part of a shared record, such as a scene that other players took part in, a log other players hold, a wiki revision or a Forum thread, and for backups, until the Content is removed under the Privacy Notice’s retention rules. Deleting your account does not oblige us to erase Content that other people wrote or that records an event they took part in, but we will unlink it from your handle where that is practical.
5.5 To the extent the law permits, you waive any moral right you have to be named or to object to the changes described in section 5.3, and you agree that the Operator owes you no payment for the use of your Content.
5.6 Other players see the Content you put in shared spaces, and you give each of them a limited licence to view and use it within the Service for play. A player may keep a log for personal use but must not publish or circulate private communications except as the Code of Conduct permits.
5.7 Your character is your original creation, but it exists within a shared setting written by many people. If your account is closed, the Operator may retire the character, keep its history as part of the world’s record, refer to it, and adapt it for the story of the game, but will not continue to present it as a player character.
5.8 You represent and warrant that you own your Content or have every right needed to submit it and to grant the licence in section 5.3, that it does not infringe any right of any person, and that it complies with the Code of Conduct, including its rules on generative artificial intelligence.
5.9 We may edit, move or remove any Content, and may refuse to host it, at our discretion. We are not obliged to monitor Content, and we do not endorse or take responsibility for what other users say. If you give us feedback or suggestions about the Service, we may use them freely and owe you no compensation.
6. The game world, items and currency
6.1 Characters, items, currency, property, reputation, skills, standing and any other progress in the game (together, “Virtual Items”) are part of a game. You receive a limited licence to use them within the Service. You do not own them, they have no monetary value, they cannot be redeemed for money or for anything else outside the Service, and no Virtual Item is your property.
6.2 The game world is dangerous by design. A character can be injured, robbed, captured, changed or permanently killed where the rules and the course of play allow it. You have no claim against the Operator or any other player for the loss, change, reset or removal of a Virtual Item or a character in play.
6.3 The Operator may change, rebalance, add, suspend or remove any part of the game, its rules, its economy and its content at any time, and may correct an error or the effect of a bug, including by reversing or removing what resulted from it. A correction of this kind is not a punishment.
6.4 A ruling by staff on a matter of play is final within the game, subject to any appeal the Code of Conduct provides for conduct.
7. The Operator’s rights, moderation and enforcement
7.1 The Operator and its staff may monitor, review, record and moderate the use of the Service, as described in the Privacy Notice, in order to enforce the Agreement, to protect the safety and security of people and of the Service, to resolve disputes and to comply with the law.
7.2 If we find or reasonably believe that you have broken the Agreement, we may take any action the Code of Conduct describes, including a warning, a restriction, a temporary measure while a concern is under review, a suspension, a permanent ban, and the removal or editing of Content. Where the Code of Conduct gives you notice and a right to appeal, those protections apply.
7.3 We may act immediately and without notice where there is a serious risk to a person or to the Service, or where the law requires it.
7.4 We may preserve, and may disclose to a court, a law-enforcement or regulatory authority or another party, information about your use of the Service where we believe in good faith that the law requires it or that it is necessary to protect the rights, property or safety of any person. We will report apparent child sexual abuse material as the law requires.
7.5 We make no promise about how quickly staff will respond to a request or a report.
8. Intellectual property
8.1 The Service and everything in it belong to the Operator or its licensors, except for your Content. This includes the setting called Deshret and its lore, and the text, pictures, sound, interface, game systems, names and marks (including “Underspire”). All of it is protected by copyright and other law.
8.2 The Operator grants you a personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own non-commercial play and participation, on the terms of the Agreement.
8.3 You must not copy, scrape in bulk, republish, sell, sublicense, reverse engineer or otherwise exploit any part of the Service for a commercial purpose, remove any notice from it, or use it to build a competing service. This section does not limit any right you have under the licence of a component that is published under an open-source licence.
8.4 Some components of the Service are the work of other people and are used under their own licences. The pixel typeface used on the Site and the Forums is Px437 IBM VGA 8x16 by VileR, used under CC BY-SA 4.0, and is credited at the foot of each page.
9. Third-party content, links and services
9.1 The Service may display, or link to, content and services that belong to other people, including pictures that users host elsewhere and websites that users cite. We do not control them, do not endorse them, and are not responsible for them or for any loss that comes from using them. Your use of a third-party service is governed by that service’s own terms and notices.
9.2 When your browser loads a picture from another website, that website receives your connection information, as described in the Privacy Notice.
10. Copyright complaints
10.1 We respect the rights of authors and artists. If you believe that Content on the Service infringes your copyright, send a notice to the Operator at archeonsolUS@gmail.com that contains (a) a physical or electronic signature of the owner of the right, or of a person authorised to act for the owner; (b) a description of the work claimed to be infringed; (c) a description of the material you say infringes it and its location on the Service, with an address where we can find it; (d) your name, postal address, telephone number and email address; (e) a statement that you have a good-faith belief that the use is not authorised by the owner, its agent or the law; and (f) a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the owner or are authorised to act for the owner.
10.2 If we remove Content because of a notice, the person who submitted it may send a counter-notice to the same address that contains (a) their signature; (b) a description of the material removed and where it appeared; (c) a statement, made under penalty of perjury, that they have a good-faith belief that it was removed by mistake or misidentification; and (d) their name, address and telephone number, and their consent to the jurisdiction of the courts of the place where they live, and to accept service of process from the person who sent the notice. We may then restore the material unless the sender of the original notice informs us that they have started a court action.
10.3 In appropriate circumstances we will end the access of a person who repeatedly infringes the rights of others.
11. Privacy
11.1 The Privacy Notice at https://underspire.net/legal/privacy/ explains what personal information we collect, why we collect it, who can see it, how long we keep it and what rights you have. By using the Service you acknowledge that we process your information as described in the Privacy Notice.
12. Disclaimers
12.1 THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT THE LAW PERMITS, THE OPERATOR DISCLAIMS EVERY WARRANTY, EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
12.2 The Operator does not warrant that the Service will be available, uninterrupted, timely, secure or free of errors, bugs or loss of data, or that any Content, Virtual Item or character will be kept. The Operator is not responsible for the conduct of any user, for Content that users submit, or for material that you may find offensive, upsetting or inaccurate.
12.3 Some places do not allow the exclusion of certain warranties. In those places the exclusions in this section apply only to the extent the law allows.
13. Limitation of liability
13.1 TO THE FULLEST EXTENT THE LAW PERMITS, THE OPERATOR WILL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR USE, ARISING OUT OF OR RELATED TO THE SERVICE OR THE AGREEMENT, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, EVEN IF THE OPERATOR HAS BEEN TOLD THAT THEY MAY OCCUR.
13.2 TO THE FULLEST EXTENT THE LAW PERMITS, THE OPERATOR’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THE AGREEMENT WILL NOT EXCEED THE GREATER OF (A) FIFTY UNITED STATES DOLLARS (US$50) AND (B) THE AMOUNT YOU HAVE PAID THE OPERATOR FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE.
13.3 Nothing in the Agreement limits or excludes liability for fraud, for gross negligence or wilful misconduct, for death or personal injury caused by negligence, or for anything else that the law does not allow to be limited or excluded.
14. Indemnity
14.1 To the extent the law permits, you will indemnify and hold harmless the Operator and the volunteers who help run the Service from any claim, loss, liability, damage and expense (including reasonable legal fees) that arises from your Content, from your breach of the Agreement, or from your violation of the law or of the rights of any person.
15. Changes to the Service and to these Terms
15.1 We may change, suspend or end any part of the Service at any time.
15.2 We may change these Terms. The date of the latest version is shown at the head of the page. For a material change we will also give notice on the Site or in the Service, and by email where an address is on file, before it takes effect. If you keep using the Service after the date a change takes effect, you accept the change. If you do not accept it, you must stop using the Service and may ask us to delete your account.
16. Termination
16.1 You may stop using the Service at any time, and may ask for your account to be deleted under section 3.4.
16.2 We may suspend or end your access, in whole or in part, as described in section 7: immediately for a serious breach, and otherwise as the Code of Conduct provides.
16.3 When your access ends, your right to use the Service ends with it. Sections 3.4, 5, 6, 7.4, 8, 10 and 12 to 18, and any other provision that by its nature should survive, will survive the end of your access.
17. Governing law and disputes
17.1 If you have a complaint or a dispute about the Service, write to us first at archeonsolUS@gmail.com, describing the problem and what you are asking for. Each of us agrees to try in good faith to resolve the dispute informally for at least thirty (30) days before starting a formal proceeding.
17.2 The Agreement, and every dispute or claim that arises out of or relates to it or to the Service, are governed by the laws of the United States of America and of the state in which the Operator resides, without regard to any rule of conflict of laws.
17.3 Subject to section 17.4, the state and federal courts that sit in the state in which the Operator resides have exclusive jurisdiction over any such dispute, and you and the Operator consent to their jurisdiction and venue.
17.4 If you are a consumer living in the European Union, the United Kingdom or another place whose law gives consumers rights that cannot be waived by contract, nothing in the Agreement removes the protection of the mandatory provisions of the law of the country where you live, and you may bring proceedings in the courts of that country where the law gives you that right.
18. General provisions
18.1 The Agreement is the entire agreement between you and the Operator about the Service and replaces all earlier agreements about it.
18.2 If a court finds a provision of the Agreement unenforceable, that provision will be enforced to the extent it can be, and the rest of the Agreement will stay in force.
18.3 A failure or delay by the Operator in exercising a right is not a waiver of it.
18.4 You may not assign or transfer the Agreement or any right under it without our written consent. We may assign it to a person who takes over the Service.
18.5 We may give you notice by posting it on the Site or in the Service, or by email to the address on your account. You consent to receive notices and other communications from us in electronic form, and agree that they satisfy any legal requirement that a communication be in writing.
18.6 The Operator is not liable for any failure or delay caused by an event beyond its reasonable control.
18.7 The Agreement is made in English, and the English text controls. In the Agreement, “including” means “including without limitation”, and headings are for convenience only. The Agreement gives no right to any person who is not a party to it, except that the Operator’s licensors may enforce section 8.
19. Contact
19.1 Questions about the Agreement, reports of abuse, requests about your information and notices under section 10 should be sent to archeonsolUS@gmail.com.
